to the Multiple Services Contract Effective February 18, 2013 |
1.1. Contractor - Joint Stock Company "Regional Network Information Center". The Contractor's web server is located at https://www.nic.ru/en/.
1.2. Partner of the Contractor - an individual person or legal entity that has signed a Multiple Services Contract.
1.3. Customer - Partner of the Contractor applying to the Contractor for registration of second-level .PW domain name for the Applicant’s name.
1.4. Applicant - an individual person or legal entity that applied to the Partner of the Contractor for registration of second-level .PW domain name (a party of the NIC-D service agreement).
1.5. Landrush Domain Name Registration - registration of second-level .PW domain names at the period of time and under the procedure as specified herein.
1.6. Registration Request - an application filed by the Contractor (Accredited Registrar) in the name and on behalf of an Applicant for the Landrush registration of a second-level .PW domain name. The registration requests may not be assigned by one party to another.
1.7. TLD Sponsor - P.D.R Solutions FZC.
1.8. Auction - organizational activities to be held by the Auction Organizer for preparing and holding Bidding for ownership of domain requests for which were submitted during the Landrush period; determining the Auction Winner and registering domain name in the name of the Auction Winner.
1.9. Auction Organizer - NameJet, LLC authorized by the PW TLD Sponsor to organize and hold auctions for domain ownership.

2.1. This Schedule sets forth the terms and conditions for Landrush registration of second-level domains in the PW TLD, and is based on and conforms to the requirements of the TLD Sponsor, P.D.R Solutions FZC.
The Contractor acts on the basis of the Agreement with the P.D.R Solutions FZC.
2.2. In any respects that have not been regulated hereunder, the Contractor and the Customer (referred to hereinafter as the Parties) shall be governed by the following documents:
2.3. The Parties shall comply with the provisions of the PW Policy Guide, which is published on the Contractor's website at: https://www.nic.ru/dns/domain/en/pw_policy_guide.pdf. Russian version is published at: https://www.nic.ru/dns/domain/pw_policy_guide.pdf. It is understood that P.D.R Solutions FZC is entitled to modify the said document by giving a notice. When construing the said document, its English version shall prevail.
2.4. This Schedule shall take effect on February 18, 2013 and remain valid until March 14, 2013 inclusive.
2.5. The Customer shall make the Applicant read this Schedule and the documents listed in clause 2.3. hereof and their amendment procedure.
2.6. A service order serves as the Customer's and the Applicant's full and unconditional consent with the terms of this Schedule, the PW Policy Guide and their amendment procedure. An Order for a service indicates also that the Customer agrees to pay for the service at the price effective at the date the processing of the Order begins.
Documents that set forth the rules for further periods of .PW domain registration and renewal will be adopted solely by the PW TLD Sponsor. The Contractor shall publish the links to the adopted documents as soon as they are published by P.D.R Solutions FZC.
2.7. If any provisions hereof run counter the provisions of the documents specified in para 2.2 of this Schedule, the provisions hereof shall prevail at construing.
3. Registration Terms and Conditions
3.1. Landrush registration requests for second-level .PW domains will be accepted from 10:00 p.m. February 18, 2013 until 11:59 p.m. March 14, 2013 (MSK).
3.2. The Customer may submit one or more Registration Requests during Landrush for any available .PW domain name.
3.3. Landrush requests may be submitted for any available .PW names, meaning names that have not been reserved, restricted, registered, awarded, or otherwise allocated prior to commencement of the Landrush period under the PW Policy Guide.
3.4. Requirements for second-level .PW domain names:
a) the name must consist exclusively of Latin letters A-Z (case insensitive), hyphens and numbers 0-9;
b) the name may not begin or end with a hyphen;
c) the name may not include more than 63 characters (aside from the top level domain extension) and less than 3 characters;
d) Internationalized Domain Names (IDNs) must comply with the IDN policy published at: https://www.centralnic.com/names/domains/idn#rules.
e) the name can only have two consecutive hyphens (--) in the 3rd and 4th positions in A-label of IDN domain.
3.5. The registration period of the domain name applied for during Landrush period must be between 2 and 10 years.
3.6. The service of Landrush registration of second-level .PW domains consists of submitting an application for Landrush registration by the Contractor into the Registry and of the domain registration itself in case of successful application evaluation by P.D.R Solutions FZC.
3.7. The application shall be evaluated by the TLD Sponsor. The service of Landrush registration shall be deemed provided since the moment the Contractor receives an answer from the TLD Sponsor, irrespective of the evaluation result. The money paid for the application evaluation will not be refunded.
3.8. If two or more Registration Requests meeting all the requirements in place are received in respect of one domain name during the Landrush period, the positively evaluated requests shall be sent by the TLD Sponsor to an auction to be organized by the authorized company, NameJet, LLC. The auction rules are published on the web server of the Auction Organizer at http://www.namejet.com/pages/promos/pw-pre-ga-faqs.aspx.
3.9. When completing the application form, the Customer shall list the Applicant's name, contact email and phone number.
3.10. The responsibility for correct and authentic data and name of the Applicant shall rest with the Customer.
3.11. the Contractor delivers the Service under the following terms:
a) the Customer has on their personal account a sufficient sum to pay for the service. The procedure of personal account recharge is described on the Contractor's website (in section "Pricing");
b) the Customer generated an order on the Contractor's web server;
c) the terms listed in subparagraphs (a, b) hereinabove are met by the end of the Landrush period in the PW TLD.
3.12. The Contractor does not guarantee delivery of the Service to the Customer in the following cases:
а) more than one application was submitted for a domain name, and the TLD Sponsor sends the domain name to the auction;
b) Landrush registration in PW TLD is not launched, or suspended;
c) in other cases likely to hinder domain name registration on a Customer's request.
3.13. Domain name registration on one application or holding an auction for ownership of domains for which several applications were submitted will be done after the end of the Landrush period.
The fee for Landrush registration of .PW domains is specified in the Pricing Schedule (Addendum 2 to the Multiple Services Contract).
The payment procedure is set forth in the documents specified in clause 2 hereof.
5.1. From the moment of record entry into the Registry (the Registrar will notify the Registrant thereof using e-mail) about domain name registration in the name of the Applicant, the latter will undertake all rights and obligations of the Registrant as stipulated by gTLD and Foreign ccTLD Registration Schedule (Schedule 1/7 to the Multiple Services Contract).
5.2. The Registrant shall:
Refrain from using the domain name for the purpose of engaging in any activities prohibited under the laws in effect in the Russian Federation, including propagation and advertising of pornographic materials, appeals to violence, pursuing any extremist actions, overthrow of power, etc., as well as any activities running counter the public interest or the principles of humanity and morality, or offending the human dignity or religious feelings, etc. It is understood that the Contractor shall be entitled to assess all on its own the Registrant's activities as to these infringing upon the laws in effect, including any cases, when the definition of any such actions is not vested in the legally enforceable enactments. 5.3. The Contractor shall be entitled to suspend the domain name delegation, should the Customer breach the provisions of section 5.2. hereinabove. The domain name delegation may be restored after the Registrant remedies breaches of the provisions hereof.
6.1. The Contractor reserves the right to change the service terms unilaterally, should the PW TLD Sponsor (P.D.R Solutions FZC) change unilaterally the PW Policy Guide. The Contractor shall notify the Registrant of such changes via communication channels and simultaneously publish such changes on the Contractor's web server.
6.2. The changes specified in clause 6.1. hereinabove shall take an immediate effect on the date of publishing.
