Schedule 1/30-3
to the Multiple Services Contract Effective January 23, 2014 |
Contractor — Joint Stock Company "Regional Network Information Center".
Partner — a person or a legal entity that has signed a Multiple Services Contract (NIC-REG) and applied for the registration of second-level .САЙТ and .ОНЛАЙН domains.
Customer — Partner of the Contractor applying to the Contractor for the registration of second-level .САЙТ and .ОНЛАЙН domains.
Applicant — a person or a legal entity applying for registration of second-level .САЙТ and .ОНЛАЙН domains (a party under the Service Agreement, index NIC-D) to the Partner of the Contractor.
Order — a request from the Customer to the Contractor, in a form determined by the Contractor, that contains all the data required for second-level domain name registration in .САЙТ and .ОНЛАЙН TLDs.
TLD Administrator - an entity which is authorized by ICANN to manage domains in the international top-level domain and to develop any relevant registration, delegation and functionality terms and conditions in gTLD.
Registry — the central database of a corresponding gTLD, which contains information about registered domain names and corresponding DNS servers, as well as other information required for the registration and delegation of domains.
Registry Operator — the legal entity responsible for the operation of Registry and providing access to the Registry for Registrars so that they can provide second-level domain name registration services.
ICANN — the corporation that holds authority for the allocation of domain names and numbers, exercises general control over the system of domain names and the space of IP addresses, including the development of rules, and ensures the efficient operation of root servers.
Registrar — any legal entity accredited by ICANN or another authorized party including TLD Administrator to provide domain name registration services and deliver required information to the Registry.
Sunrise domain name registration in .САЙТ, .ОНЛАЙН TLDs — a service delivered by the Contractor to the Customer, consisting in submission to the Registry of a second-level domain name sunrise registration application in .САЙТ, .ОНЛАЙН TLDs upon the start of the appropriate Sunrise domain name registration period in .САЙТ, .ОНЛАЙН TLDs and transferring the domain name (entry of corresponding record into the Registry) to the Applicant under the policies, established by the TLD Administrator and corresponding Registry Operator, as well as informing the Customer about the policy, time of registration, prices for the selected domain name.
Landrush domain name registration in .САЙТ or .ОНЛАЙН TLD — a service delivered by the Contractor to the Customer, consisting in submission to the Registry of a second domain name registration application in .САЙТ, .ОНЛАЙН TLDs upon the start of the appropriate Landrush domain name registration period in .САЙТ, .ОНЛАЙН TLDs and transferring the domain name (entry of corresponding record into the Registry) to the Applicant under the policies, established by the TLD Administrator and corresponding Registry Operator, as well as informing the Customer about the policy, time of registration, prices for the selected domain name.
Trademark Clearinghouse (TMCH) — a Trademark Repository for brands protection as part of ICANN new program "new gTLD". The Clearinghouse functions include: (i) authentication of contact information and verification of Trademark record, and (ii) storing such records in TMCH database to provide information to the new gTLD Registries.
Trademark Owners — individuals or legal entities and their designees (such as licensees or assignees) that have or desire to have their eligible trademark rights included in the Clearinghouse.
SMD file (Signed Mark Data) — the file that is generated once the Applicant's application fulfills the Sunrise Eligibility Requirements. This file allows to register a second-level domain name in new TLD as part of the Sunrise period, providing compliance with the corresponding Registry Operator's policy. SMD file may be used by the Trademark Owner or Trademark Agent to submit Sunrise application within the Sunrise period.
Domain Name Label — Trademark spelling in the character sequence confirmed by TMCH. For every Trademark several possible label spellings are available. All Labels are listed in the SMD file details.
Trademark is an image used for individualization of goods, performed work or provided services by legal entities or individuals, registered as a trademark under the applicable national or regional (i.e. multinational) legislation in federal executive authority for intellectual property or main register of the appropriate jurisdiction.
Claims Notice — mandatory notification of the Applicant by the Contractor to the effect that the domain name for which an Order was submitted is the claimed domain name registration. This Notification contains information about a trademark and its owner. The notification about claimed domain is submitted in electronic form by the Contractor to the Applicant's e-mail address specified by the Customer during registration at Customer's web server. This notification contains information that the domain name assumed for registration matches at least one trademark included into TMCH.
2.1. This Schedule sets forth the conditions for providing Landrush second-level domain name registration service in .САЙТ, .ОНЛАЙН TLDs.
2.2. The Contractor is a Registrar accredited by ICANN and the Administrator of .САЙТ and .ОНЛАЙН TLDs to provide Sunrise and Landrush second-level domain name registration service in .САЙТ, .ОНЛАЙН TLDs.
The Contractor provides domain name registration services in .САЙТ, .ОНЛАЙН TLDs under the Agreement entered into by and between the Contractor and CORE Association, Administrator and Registry Operator of the aforementioned TLDs.
2.3. A service is provided to the Customer based on the Agreement, so long as there is an Order for the service and all the relevant requirements of this Schedule are met.
2.4. A Customer agrees that any information the Customer provides by filling in applications and other documents, including those in an electronic form, under sections of these documents marked as "open", will be placed by the Contractor on the search engines and will be open to the general public. A list of the information that will be made public and information that may be made public with the Customer's consent is available on the Contractor's website.
2.5. Service Order serves Customer's and Applicant's full and unconditional consent with the terms of this Schedule, procedure of its modification and TLD Administrator's Terms and Policies.
2.6. Service Order indicates the Customer's agreement to pay for the service at the prices valid on the day the processing of the Order begins.
2.7. Sunrise and Landrush second-level domain name registration service in .САЙТ, .ОНЛАЙН TLDs shall be deemed provided from the date the information about the domain name has been entered into the Registry.
2.8. In any commitments and relationships, which have not been regulated hereunder, but arising out of the service delivery process, the Contractor and the Customer shall be governed by the following documents:
2.9. Changes into this Schedule regarding introduction of new and (or) additional services take effect from their publishing on the Contractor's web server.
3. Terms and Procedure of Service Delivery
3.1. Sunrise second-level domain name registration in .САЙТ, .ОНЛАЙН TLDs shall be performed in relation to:
3.1.1. domain name corresponding to the specific Label in SMD file for Owners of Cyrillic trademarks registered in Trademark Clearinghouse (TMCH) — Sunrise Priority 1 Category.
3.1.2. domain name fully matching the Cyrillic trademark for Owners of Cyrillic trademarks not registered in Trademark Clearinghouse (TMCH) — Sunrise Priority 2 Category.
3.1.3. domain name corresponding to the transliterated specific Latin Label in SMD files for Owners of trademarks registered in Trademark Clearinghouse (TMCH) — Sunrise Priority 3 Category.
3.2. Landrush second-level domain name registration in .САЙТ, .ОНЛАЙН TLDs shall be performed in relation to domain names that meet the requirements specified in section 3.3.
3.3. Requirements for second-level domain names in .САЙТ, .ОНЛАЙН TLDs whereby the Order for Sunrise and Landrush domain name registration may be processed and service is provided:
a) Cyrillic domain name will begin and end with a Cyrillic letter or a number;
b) intermediate may be Cyrillic characters, numbers or a hyphen;
c) minimum length of the Cyrillic domain name makes up 3 symbols; maximum length is defined by domain presentation, which is limited by 63 symbols.
3.4. Second-level domain names within the Sunrise registration in .САЙТ, .ОНЛАЙН TLDs are registered for 2-years period, within the Landrush registration — for 1-year period.
3.5. The Contractor shall deliver Sunrise and Landrush registration service to the Customer, provided the following requirements are met:
3.6. The expiry date of the Sunrise and Landrush domain names registration period in .САЙТ, .ОНЛАЙН TLDs is March 18, 2014.
3.7. A paid Sunrise and Landrush domain name registration order in .САЙТ, .ОНЛАЙН TLDs is to be processed by the TLD Administrator.
3.8. Applications for Sunrise and Landrush registration of second-level domain names in .САЙТ and .ОНЛАЙН TLDs submitted by the Customer as part of the Sunrise or Landrush registration service will be accepted until the end of the Sunrise and Landrush registration period and will be reviewed by the TLD Administrator when it is over. Application submission priority is irrelevant. The decision on such application will be made by the TLD Administrator in its sole discretion.
3.9. It is the TLD Administrator, who will determine, whether applications for Sunrise or Landrush registration of .САЙТ and .ОНЛАЙН domain names conform to the Terms and Policies of the TLD Administrator.
3.10. If upon fulfillment of all the terms specified in sections 3.3. and 3.5. hereinabove the corresponding Registry contains information that the ordered domain name of Sunrise Priority 2 or Priority 3 Category is a claimed domain name, the Contractor will submit to the Applicant's e-mail a Claims Notice. Within 48 hours after receiving such message, the Applicant shall additionally confirm its consent to submit the Order for such domain name during the Sunrise and Landrush registration period in .САЙТ and .ОНЛАЙН TLDs.
3.11. If several eligible applications for a particular category of Sunrise or Landrush registration are received in respect of one domain name during the Sunrise and Landrush registration period in the top-level domains .САЙТ and .ОНЛАЙН, the positively reviewed applications will be submitted to a private auction by the TLD Administrator. The auction rules are established by the TLD Administrator.
4.1. The service order is made by the Customer on the Contractor's web server in the "Manage your account" section.
4.2. For each second-level domain name corresponding to any Label in SMD file the Customer shall submit a separate Order for Sunrise or Landrush domain name registration, each of which must be paid separately.
4.3. When ordering Sunrise registration in .САЙТ and .ОНЛАЙН TLDs, the Customer shall submit to the Contractor a pre-formed request, which is an electronic message sent through the Contractor's web server. For Sunrise Priority 1 or Priority 3 Category such message shall contain a SMD file, for Sunrise Priority 2 Category such message shall contain trademark information.
4.4. An Order is considered ready for processing and starts being processed when the Customer has on its Contract Account the funds sufficient to cover all services listed in the Order.
4.5. All applications for Sunrise and Landrush domain name registration in .САЙТ and .ОНЛАЙН TLDs unpaid by the end of the Sunrise and Landrush registration period in the Registry will be canceled.
4.6. The Customer may cancel the service Order prior to the beginning of Order implementation. The Order may be canceled on the Contractor's web server in the "Manage your account" section.
4.7. Orders execution procedure:
4.7.1. Orders for Sunrise domain name registration in .САЙТ and .ОНЛАЙН TLDs have priority over Orders for Landrush registration.
4.7.2. Orders for a higher category of Sunrise domain name registration in .САЙТ and .ОНЛАЙН TLDs have priority over Orders for a lower category of Sunrise registration.
5.1. The price of Sunset and Landrush domain name registration in .САЙТ and .ОНЛАЙН TLDs is given in Pricing (Addendum 1 to Schedule 1/30-1).
5.2. Money for submission of application for Sunset or Landrush domain name registration will be fully refunded to the Customer if domain name is not registered for the Applicant after all.
