to the Multiple Services Contract Effective March 18, 2013 |
Contractor — Joint Stock Company "Regional Network Information Center". The Contractor's web server is located at https://www.nic.ru/
Partner of the Contractor (Partner) — an individual person or legal entity that has signed a Multiple Services Contract (NIC-REG).
Customer — Partner of the Contractor, who made an order to the Contractor for a second—level domain registration in PW TLD for the Applicant.
Applicant — a person or a legal entity applying for the registration of second—level PW domain (a party under Service Agreement, index NIC—D) to the Partner of the Contractor.
PW domains preorder registration - a service delivered by the Contractor to the Customer (Service), consisting in submission to the Registry of a second domain name registration in PW TLD for a person indicated by the Customer in the service order upon the start of PW General Availability period and vesting the Applicant, indicated by the Customer in the service order, to act as a Registrant (record entry into the Registry).
Preorder — Customer's address to the Contractor in the format established by the Contractor containing all necessary data for domain name registration.
Registration Request - a request submitted by the Contractor (Accredited Registrar) in the name and on behalf of an Applicant, indicated by the Customer in the service order, for the registration of a second-level .PW domain name.
The registration requests may not be assigned by one party to another.
TLD Sponsor — P.D.R Solutions FZC.
Note: Terminology not defined in this Schedule is defined in gTLD and foreign ccTLD Registration Schedule (Schedule 1/7 to the Service Agreement); and gTLD and foreign ccTLD Registration Agreement.
2.1. This Schedule sets forth the terms and conditions for preorder registration of second-level domains in the PW TLD, and is based on and conforms to the requirements of the ccTLD Sponsor, P.D.R Solutions FZC.
The Contractor acts on the basis of the Agreement with the P.D.R Solutions FZC.
2.2. In any respects, which have not been regulated hereunder, the Contractor and the Customer (referred to hereinafter as the Parties) shall be governed by the below documents:
2.3. The Parties shall comply with the provisions of the PW Policy Guide, which is published on the Contractor's website at: https://www.nic.ru/dns/domain/en/pw_policy_guide.pdf.
Russian version is published at: https://www.nic.ru/dns/domain/pw_policy_guide.pdf. It is understood that P.D.R Solutions FZC is entitled to modify the said document by giving a notice. When construing the said document, its English version shall prevail.
2.4. This Schedule shall take effect on 18 March, 2013 and remain valid until 24 March, 2013 inclusive.
2.5. The Customer shall acknowledge the Applicant with this Schedule and the documents listed in para. 2.3 hereinabove and the procedure of their modification.
2.6. A service order serves as the Customer's full and unconditional consent with the terms of this Schedule, the PW Policy Guide and their amendment procedure. An Order for a service indicates also that the Customer agrees to pay for the service at the price effective on the date the processing of the Order begins.
Documents that set forth the policy of further .PW registration and renewal periods will be adopted solely by the PW TLD Sponsor. The Contractor shall publish the links to the adopted documents as soon as they are published by P.D.R Solutions FZC.
2.7. If any provisions hereof run counter the provisions of the documents specified in para 2.2 of this Schedule, the provisions hereof shall prevail at construing.
3. Registration Terms and Conditions
3.1. Preorder registration requests for second-level .PW domains will be accepted from 18 March, 2013 04:00 p.m. until 24 March, 2013 11:59 p.m. (MSK) inclusive.
3.2. Preorder requests may be submitted for any available .PW names, meaning names that have not been reserved, restricted, registered, awarded, or otherwise allocated in the previous periods under the PW Policy Guide.
3.3. Requirements for second-level .PW domain names:
a) the name must consist exclusively of the Latin letters A-Z (case insensitive), the hyphen character and the numbers 0-9;
b) the name cannot begin or end with a hyphen;
c) the name cannot include more than 63 characters (aside from the top level domain extension) and less than 3 characters;
d) Internationalized Domain Names (IDNs) must comply with the IDN policy published at: https://www.centralnic.com/names/domains/idn#rules.
The Russian version is published at the Contractor's website https://www.nic.ru/dns/domain/pw_idn.html;
e) the name can only have two consecutive hyphens (--) in the 3rd and 4th positions only in IDN presentation.
3.4. Preorder request can be submitted for domain name registration for a period of 1-10 years.
3.5. the Contractor delivers the Service under the following terms:
a) the Customer has on his/her personal account a sufficient sum to cover the service. The procedure of personal account recharge is described on the Contractor's web-server (in Pricing section);
b) The Customer generated a preorder on the Contractor's web-server;
c) the terms listed in subparagraphs (a, b) hereinabove shall be met by the start of domains registration in PW TLD.
3.6. the Contractor does not guarantee delivery of the Service to the Customer in the following cases:
a) if the Contractor's preorder request in the Registry was not a single one among those submitted by other Registrars;
b) if the domain name is already registered;
c) if domains registration in PW TLD has not launched yet, or suspended;
d) in other cases likely to hinder domain name registration based on a Customer's preorder request.
e) in other cases likely to cause third parties' rights violation as deemed by the Contractor.
3.7. When filling-in the request form the Customer shall specify the Applicant's name, contact e-mail and phone.
3.8. The Customer is solely responsible for the accuracy and validity of the Applicant's contact data and name in the request.
3.9. A completed preorder goes into action upon the start of PW domains General Availability period. In this case:
а) if the Contractor successfully completed domain name registration in the Registry, the Contractor will ensure a domain registration (record entry to the Registry) for the Customer, if his request was submitted earlier that other applicants' requests.
b) if the Contractor's preorder request for domain registration in the Registry was not a single one among those submitted by other Registrars, a preorder will be canceled. In this case the money will be released on the Customer's personal account and may be refunded by his/her official letter with specification of recipient's details, or used by the Customer for payment for other Contractor's services.
PW preorder registration fees are set forth in Addendum 2 to the Multiple Services Contract.
The payment procedure is set forth in the documents specified in clause 2 hereinabove.
5.1. From the moment of record entry into the Registry (the Registrar will notify the Registrant thereof using e-mail) about domain name registration in the name of the Applicant, the latter will undertake all rights and obligations of the Registrant as stipulated by gTLD and Foreign ccTLD Registration Schedule (Schedule 1/7 to the Multiple Services Contract).
5.2. The Registrant shall:
Refrain from using the domain name for the purpose of engaging in any activities prohibited under the laws in effect in the Russian Federation, including propagation and advertising of pornographic materials, appeals to violence, pursuing any extremist actions, overthrow of power, et al., as well as any activities running counter the public interest or the principles of humanity and morality, or offending the human dignity or religious feelings, etc. It is understood that the Contractor shall be entitled to assess all on its own the Customer's activities as to these infringing upon the laws in effect, including any cases, when the definition of any such actions is not vested in the legally enforceable enactments. 5.3. The Contractor shall be entitled to suspend the domain name delegation for breaching by the Registrant of the provisions of section 5.2. hereinabove. The domain name delegation may be restored after the Registrant remedies breaches of the provisions hereof.
6.1. The Contractor reserves the right to change the preorder registration terms unilaterally and change this Schedule, should the PW TLD Sponsor (P.D.R Solutions FZC) change unilaterally the PW Policy Guide. The Contractor shall notify the Customer of such changes via communication channels and simultaneously publish such changes on the Contractor's web server.
6.2. The modifications specified in section 6.1. hereinabove shall take an immediate effect on the publishing date.
