Contractor — Joint Stock Company "Regional Network Information Center".
Customer — a person or a legal entity applying for the registration of second-level New gTLD domain.
gTLD Administrator — an entity which is authorized by ICANN to manage domains in the international top-level domain and to develop any relevant registration, delegation and functionality terms and conditions.
Registry — the central database of a corresponding gTLD, which contains information about registered domain names and corresponding DNS servers, as well as other information required for the registration and delegation of domains.
Registry Operator — a legal entity responsible for the operation of the Registry and providing access to the Registry for Registrars so that they can provide second-level domain name registration services.
ICANN — the corporation that holds authority for the allocation of domain names and numbers, exercises general control over the system of domain names and the space of IP addresses, including the development of rules, and ensures the efficient operation of root servers.
Registrar — any legal entity accredited by ICANN or another authorized party, including gTLD Administrator, to provide domain name registration services and deliver required information to the Registry.
New gTLD Domains Sunrise Registration — a service delivered by the Contractor to the Customer consisting of two parts:
New gTLD Domains Sunrise Registration for .ОРГ TLD — a service delivered by the Contractor to the Customer consisting of a domain name registration request on a first-come, first-serve based of the person who fulfilled all the requirements envisaged by clause 2.8 hereinbelow.
New gTLDs — new areas of the Internet hierarchical name space allocated by ICANN under New gTLD Program. In the Domain Name System (DNS) it is the highest hierarchy level of the hierarchy after the root. In the Domain Name System (DNS) it is the highest hierarchy level of the hierarchy after the root.
Trademark Clearinghouse (TMCH) — a Trademark Repository for the brands protection as part of ICANN New gTLD Program. Clearinghouse functions include: (i) authentication of contact information and verification of Trademark record, and (ii) storing such records in TMCH database to provide information to the new gTLD Registries.
Trademark Owners — individuals or legal entities and their designees (such as licensees or assignees) that have or desire to have, their eligible trademark rights included in the Clearinghouse.
SMD file (Signed Mark Data) — the file that is generated once you fulfill the Sunrise Eligibility Requirements. This file allows you to register a second-level domain name in new TLD in the Sunrise period, provided you comply with the registries policy. SMD file may be used by the Trademark Owner or Trademark Agent to submit Sunrise application within the Sunrise period.
Domain name label — Trademark spelling in the character sequence confirmed by TMCH. For every Trademark several possible label spellings are available. All Labels are listed in the SMD file details.
Trademark — an image used for individualization of goods, performed work or provided services by legal entities or individuals, registered as a trademark under the applicable national or regional (i.e. multinational) legislation in federal executive authority for intellectual property or main register of the appropriate jurisdiction.
Auction — Registry Operator's and/or gTLD Administrator's organizational activities aimed to prepare and hold the Bidding for the right to administer the domain name that was ordered during the Sunrise period; selection of the auction Winner and domain registration to the name of the auction Winner.
Auction Organizer — a person authorized by the gTLD Administrator and/or Registry Operator of the corresponding top-level domain to hold the Auction.
2.1. This Schedule sets forth the conditions for providing the New gTLD second-level domain Sunrise registration service.
2.2. The Contractor is a Registrar accredited by ICANN and other authorized entities, including New gTLD Administrators, to provide the New gTLD second-level domain Sunrise registration service. The Contractor performs registration of domain names:
2.3. Terminology not defined in this Schedule is defined in the below documents:
2.4. A New gTLD domain Sunrise Registration Service Order serves Customer's full and unconditional consent with the terms of this Schedule and the procedure of its modification.
2.5. The service order serves Customer's full and unconditional consent with the terms of the corresponding gTLD Administrator and Registry Operator Policies, as well with all rules, policies, standards, procedures and methods approved by ICANN applicable to the top-level domain, including:.
- consent to participate in the dispute resolution process pursuant to ICANN Uniform Dispute Resolution Policy (UDRP);
- consent to participate in the dispute resolution process pursuant to ICANN Uniform Rapid Suspension System Policy (URS).
2.6. The service order serves Customer's consent to pay for the service at the prices valid on the date the order execution begins. The service order is made by the Customer on the Contractor's web server in "Manage your account" panel.
2.7. In the process of making an order for the service the Customer provides to the Contractor a pre-formed request, which is an electronic message sent through the Contractor's web server and containing SMD file.
2.8. An order is considered available and starts processing provided the following terms are met:
2.8.1. An order in .ДЕТИ is considered available and starts processing provided the terms in clause 2.8. hereinabove and the .ДЕТИ TLD Administrator’s requirements are met:
2.8.2 In .МОСКВА, .MOSCOW gTLDs an order is considered available and starts processing provided the terms specified in 2.8 hereinabove and the below requirements set forth by the gTLD Administrator are met:
2.8.3. In .TATAR gTLD an order is considered available and starts processing provided the terms specified in 2.8 hereinabove and the below requirements set forth by the .TATAR Administrator are met:
2.9. The Customer may cancel the order for the service on his own initiative prior to the beginning of order implementation. Order may be canceled on the Contractor's web server in "Manage your account" panel.
2.10. A Customer agrees that any information the Customer provides by filling in applications and other documents, including those in an electronic form, under sections of these documents marked as "open", will be placed by the Contractor on the search engines and will be open to the general public. A list of the information that will be made public and information that may be made public with the Customer's consent can be found on the Contractor's web site.
2.11. A service is provided to the Customer based on the Agreement with the Contractor as long as there is an order for the service and all the relevant requirements of this Schedule are met.
2.12. Changes into this Schedule regarding introduction of new and (or) additional services take effect from their publishing on the Contractor's web server.
2.13. The Contractor may unilaterally amend this Schedule with a notification to the Customer through publishing such amendments on the Contractor’s website at https://www.nic.ru (the "Contractor's web server").
2.14. If two or more Sunrise Registration Applications meeting all the requirements are received in respect of one .ДЕТИ domain name, such applications will be sent by .ДЕТИ TLD Administrator to the auction to be organized by the Pool.com, Inc., an authorized company.
2.15. Auction procedures for .ДЕТИ shall be determined by .ДЕТИ TLD Administrator and published on its official website at: http://en.dotdeti.ru/docs/
2.16. After processing the application, .ДЕТИ TLD Administrator may reject Sunrise registration of .ДЕТИ domain name because of the reasons specified by Pool.com, Inc.
2.17. If two or more .TATAR registration requests meeting all the requirements are received in respect of one domain name during the Sunrise period, the right to priority registration of such domain name will be determined at a private auction in the manner prescribed by the gTLD Administrator. The associated documents are available on the official website at: http://domain.tatar/users/documents.php.
2.18. If two or more .SHOP registration requests meeting all the requirements are received in respect of one domain name during the Sunrise period, the right to priority registration of such domain name will be determined at a private auction in the manner prescribed by the gTLD Administrator.
2.19. The Registrant undertakes to indemnify to the Registry Operator (and to its directors, officials, employees and agents) for any losses related to, or arising out of Registrant's operations with respect to domain name registration or use, including, but not limited to, renewal, deletion and (or) inter-Registrar transfer of this domain name.
2.20. The Registrant shall abstain from distributing malware, abusively operating botnets, phishing, piracy, trademark or copyright infringement, fraudulent or deceptive practices, counterfeiting or otherwise engaging in activities contrary to applicable law. Otherwise, domain name delegation may be suspended for the Registrant.
2.21. With regard to a domain name in highly-regulated .DOCTOR Registrants must agree that:
- Registrants must possess any necessary authorizations, charters, licenses and/or other related credentials for participation in the sector associated with such Highly-regulated TLD and report any material changes with regard to the above listed documents.
3.1. New gTLD second-level domain Sunrise registration shall be performed in respect of the domain name corresponding to the specific Domain name label for Owners of Trademarks registered in Trademark Clearinghouse.
3.2. For each second-level domain name corresponding to any Domain name label the Customer shall submit a separate domain name Sunrise registration order, each of which must be paid separately.
3.3. Sunrise registration service may not be delivered by the Contractor and the domain name may not be registered in the following cases:
a) the Contractor's application in the Registry for domain name registration under New gTLD Program was not a single one among those submitted by other Registrars (except for allocation of domain names through an auction held by the Registry Operator or an entity authorized by);
b) domain name registration is cancelled by an enacted court decision, when a person, whose rights are deemed violated by the court, has a priority to a cancelled domain registration;
c) the domain name is a subject of legal proceedings, provided that the Contractor has the appropriate evidence confirming that the domain name is the issue in the litigation;
d) the domain name registration is in contradiction of the Terms and Conditions for Domain Names Registration established by the TLD Administrator.
e) the domain name has already been registered;
f) two or more requests have been submitted for the domain name and the auction for it is holding by the Registry Operator;
g) Sunrise registration of domain names in the top-level domain has not yet been launched, or has been suspended/completed;
h) in other cases likely to cause third parties' rights violation as deemed by the Contractor.
3.4. The requirements to second-level domain names in .ACADEMY, .ACCOUNTANTS, .AGENCY, .APARTMENTS, .ASSOCIATES, .BARGAINS, .BIKE, .BINGO, .BOUTIQUE,.BUILDERS, .BUSINESS, .CAB, .CAFE, .CAMERA, .CAMP, .CAPITAL, .CARDS, .CARE, .CAREERS, .CASINO, .CASH, .CATERING, .CENTER, .CHAT, .CHEAP, .CHURCH,. a) the name shall consist exclusively of the letters A-Z (case insensitive), the hyphen character and the numbers 0-9;
b) the name may not begin or end with a hyphen;
c) the name may not contain hyphens as its third or fourth characters;
d) the name may not include more than 63 (sixty-three) characters (apart from the top level domain extension),
e) the name shall contain at least one character (aside from the top level domain extension).
3.5. The requirements to the second-level domain name in the domains of United TLD Holdco Ltd. Registry Operator: .ACTOR, .DANCE, .DEMOCRAT, .FUTBOL, .HAUS, .IMMOBILIEN, .LIVE, .NINJA, .REVIEWS, .ROCKS, .SALE, .SOCIAL, .STUDIO, .VIDEO, in the domains of PUNTO 2012, S.A.P.I. DE C.V Registry Operator: .BAR, .REST and in domains of Top Level Design, LLC Registry Operator: .INK and .DESIGN, at which Sunrise Order for a domain name registration may be processed, and the service may be delivered:
a) the name may not begin or end with a hyphen;
b) the name may not contain hyphens as its third or fourth characters;
c) minimum length of the Cyrillic domain name makes up 3 (three) symbols;
d) maximum length is defined by domain presentation, which is limited by 63 (sixty-three) symbols.
3.6. Second-level .ДЕТИ domain names must meet the following requirements:
a) contain only Russian letters (including “ё”), digits and hyphens (case-insensitive);
b) contain at least three (3) characters; Punycode representation must contain maximum sixty three (63) characters;
c) start and end with a letter of digit.
3.7. Second-level domain name in .ОРГ top level domain shall meet the following requirements:
a) the name shall consist of at least 3 (three) characters and shall not exceed the amount of characters, which in Punycode code would be limited by 63 (sixty three) characters;
b) end and begin with letter or digit.
3.8. Second-level domain name in gTLD domain. МОСКВА shall meet the below requirements:
a) full domain name ends with .МОСКВА characters;
b) domain name starts and ends with a Russian Cyrillic letter or a number;
c) intermediate characters may be Russian Cyrillic letters, numbers, or a hyphen; Cyrillic characters allow UTF-8 characters from "а" (code 0430) to "я" (code 044F) and an additional character "ё" (code 0451).
d) domain name is at least one character long;
e) domain name contains such a number of characters that its representation will not exceed 63 (sixty-three) characters. The representation is achieved by transforming the Cyrillic domain name in compliance with the Punycode algorithm (given in technical standards RFC-3490, 3491, 3492).
f) domain name reproduces in full the verbal appellation of the trademark or is identical with the verbal appellation of the trademark after its spaces or other symbols are deleted or after the spaces or other symbols are replaced with hyphens. Therefore, the verbal appellation of a trademark should include at least one protected element.
3.9. Second-level domain name in gTLD domain. MOSCOW shall meet the below requirements:
a) full domain name ends with .MOSCOW characters;
b) domain name starts and ends with a Latin letter or a number;
c) intermediate characters may be Latin letters, numbers, or a hyphen; Latin characters allow UTF-8 characters from "а" (code 0061) to "z" (code 007A).
d) domain name is at least one character long;
e) the name cannot include more than 63 (sixty-three) characters;
f) domain name reproduces in full the verbal appellation of the trademark or is identical with the verbal appellation of the trademark after its spaces or other symbols are deleted or after the spaces or other symbols are replaced with hyphens. Therefore, the verbal appellation of a trademark should include at least one protected element.
3.10. Second-level domain name in .TATAR TLD shall meet the following requirements:
a) the domain name has no characters other than Latin symbols (a-z), Arabic digits (0-9) and a hyphen (case insensitive);
b) the domain name contains at least 3 (three) and not more than 63 (sixty-three) characters;
c) the domain name will begin and end with a Cyrillic letter or a number;
d) there are no hyphens in third and forth positions (for example ab--cde.tatar).
3.11. Second-level domain name in .YOGA, .CASA, .WORK, .SITE, .TECH TLDs shall meet the following requirements:
a) the name cannot begin or end with a hyphen;
b) the name cannot have two or more consecutive hyphens;
c) minimum length of domain name is 3 (three) characters (excluding the TLD extension);
d) maximum length of domain name is determined by the length of representation; the length of domain name representation cannot exceed 63 (sixty-three) characters.
3.12. Second-level domain name in .SHOP TLD shall meet the following requirements:
a) the name cannot begin or end with a hyphen;
b) the name cannot have two or more consecutive hyphens;
c) minimum length of domain name is 1 (one) character (excluding the TLD extension);
d) maximum length of domain name is determined by the length of representation; the length of domain name representation cannot exceed 63 (sixty-three) characters.
3.13. New gTLD domain name Sunrise Registration Applications submitted by the Customer within Sunrise Registration Service will be accepted until the end of the Sunrise period and will be reviewed by the gTLD Administrator upon its completion. Application submission priority is irrelevant. Applications are accepted by the Registry at its sole discretion.
3.14. Domain name priority registration applications in .ОРГ TLD generated by the Customer as part of priority registration service delivery will be submitted to the Registry for the whole priority registration period. Should the Registry accept Contractor's application for domain name registration earlier than the applications for such domain name registration accepted from other Registrars, such domain name will be registered (the exception from such rule is specified in item 3.3. hereinabove).
3.15. Domain names under this Schedule are registered for 1-year period. After expiration of this term domain names may be renewed subject to the terms of Schedule 1/7 to the Service Agreement.
3.15.1 Second-level domain names in .ОРГ top-level domain are registered for a 5-year period.
3.16. The Sunrise Registration Service for the part of the application submission shall be deemed provided from the moment the Contractor receives an answer from the gTLD Administrator, irrespective of the evaluation result.
3.17. Verification of Sunrise Registration Applications is made by the gTLD Administrator and/or Registry Operator. Sunrise Registration Application submission fee will not be refunded.
The exception is made for second-level .ДЕТИ, .ОРГ, .МОСКВА, .MOSCOW, .TATAR domain names for which applications are submitted free of charge.
3.18. The Sunrise Registration Service for the part of the domain name registration shall be deemed provided from the moment of entry of record about the domain registered in the Customer's name into the corresponding TLD Registry.
3.19. During the term of Sunrise registration, Registrants of .ДЕТИ, МОСКВА, .MOSCOW, .TATAR second-level domain names may not:
3.20. Domain names delegation in .МОСКВА, .MOSCOW gTLDs registered in Sunrise order under this Schedule shall be provided not earlier than in 3 (three), but not later than in 14 (fourteen) calendar days upon completion of the Sunrise procedure.
3.21. Upon domain name registration, the Registrant shall validate the email address specified in Whois-contact (Registrant type — field "Email") for the domain name by following the link sent by the Contractor to this address. The Registrant at its own discretion may initiate the dispatch of a message containing a confirmation link in "Manage your account" panel on the Contractor's web site.
3.21.1. If the Registrant fails to validate an email address (fails to perform the actions set forth in para 3.21. hereof) within fifteen (15) calendar days, delegation of the domain name, after registration of which validation is required, will be suspended.
Delegation suspension procedure is established by the Contractor and available on its web server. Since the moment the delegation of a domain with the DNS specified by the Registrant or authorized Partner (by RU-CENTER for .TEL domains) is suspended, all the HTTP queries to the domain can be forwarded to the Contractor's page to inform about the service suspension. The Contractor may publish on the service page other Contractor's or third-party materials in any way not contrary to the laws in effect in the Russian Federation and the Agreement.
3.21.2. Delegation of the domain name specified in para 3.21.1. hereof will be restored after email validation by the Registrant in the manner specified in para 3.21 hereof.
3.21.3. If the email address has been validated in the manner specified in para 3.21. hereof, as well as during the registration, domain name transfer to another registrar or other actions which require such validation in accordance with the requirements of the Registrar or Registry Operator, re-validation of email is not required.
3.22. If DNS servers for domain are not specified, http-request to the domain may be redirected to the Contractor's service page to notify about unavailability of the requested page. The Contractor may accommodate on the service page other Contractor's or third party materials in any way not contrary to the laws in effect in the Russian Federation and the Service Agreement. The Customer is entitled at any moment within the domain name registration period to specify another page for redirection or cancel redirection to the Contractor's service page in "Manage your account" panel.
4.1. The New gTLD Sunrise Registration Service fee is specified in the Pricing (Addendum 1 to the Schedule 1/30-1 to the Service Agreement and Addendum 2 to the Service Agreement) and consists of:
4.1.1. Fee for gTLD second-level domain sunrise registration application submission and
The exception is second-level .ДЕТИ and .ОРГ domain names for which applications are submitted free of charge.
4.1.2. gTLD second-level domain registration fee. Payment for the domain registration and sunrise registration application submission should be made concurrently.
4.1.3. deposit and bid for the second-level .ДЕТИ domain name in the case it was sent to the private auction by the TLD Administrator pursuant to clause 2.15. hereof and pursuant to the documents describing the terms and conditions of auctions, the current version of which is published on the official website of gTLD Registry Operator at: http://en.dotdeti.ru/docs.
4.2. A aid new gTLD domain Sunrise Registration order is to be processed by the gTLD Administrator.
4.3. The Contractor provides a Customer with the Sunrise Registration Service after reserving sufficient money in the Personal account of the Customer's Contract. Money that is allocated for a service cannot be used to pay for another service.
4.4. If two or more Sunrise Registration Applications meeting all the requirements are received in respect of one domain name during the Sunrise period, the positively evaluated applications will be sent to a private auction to be organized by the Auction Organizer. The auction rules are established by the gTLD Administrator.
